Draft: pending review
Terms of use
Last updated
This is a working draft, not final terms, and it is not legal advice. It has not been reviewed by a lawyer.
NAND Loyalty is a digital loyalty card that local businesses offer their customers. It is operated by [[OWNER: legal name]] (“we”). These terms are for customers who use a card. By signing in or joining a card, you agree to them. How we handle your information is in the privacy notice.
Your card
- You sign in with your phone number. Keep access to it: anyone who can read your texts can sign in as you.
- A card belongs to one business. The business, not us, decides how many stamps a reward needs, what the reward is, when it expires and who may collect stamps.
- Stamps and rewards have no cash value, can’t be sold or transferred, and can’t be exchanged for money.
- A business’s staff can fix a mistake on your card (for example a missed stamp). The fix is recorded as a new entry, so the history stays accurate.
- Rewards can expire. The business decides when.
Using it fairly
Please don’t:
- collect stamps you didn’t earn, or help someone else do it;
- use more than one account, or someone else’s phone number, to collect stamps or rewards;
- scan, copy or repeat tags and codes automatically, or try to get around the limits that protect the service;
- try to reach another person’s or business’s information.
We and the businesses can stop stamps or rewards that came from misuse, and we can suspend an account that misuses the service. A suspended account can’t join cards or change text-offer choices, and you can still ask us to delete it.
Text offers
A business texts you offers only if you ticked its box to say yes. Joining a card never signs you up. You can stop a business’s offers at any time with the Text offers switch on your card or the opt-out link in its texts, and replying STOP stops offers from every business. A business can also turn on a text that says your reward is ready; it carries a link that stops it. The privacy notice has the details.
Businesses on NAND Loyalty
Each business is responsible for its own card, rewards and offers. We provide the service they run it on; we are not the seller of what they offer and don’t guarantee a business’s rewards. A business can end or change its card, or close on NAND Loyalty. When a business closes, its card stops working and, after 30 days, its data is deleted. If we suspend a business, its card is hidden and it sends no texts, but nothing is deleted. Your account and your cards at other businesses are not affected.
Your account
You can delete your account yourself on Your details. Your name, phone number and sign-in are erased, your cards close and unused rewards can no longer be used, and it can’t be undone. Your past visits stay with each business only as an anonymous history, without your name or number. We may also delete accounts that have been inactive for 2 years, as the privacy notice describes.
Availability
We work to keep the service running, but it may be unavailable at times, for example for maintenance, a problem with a provider, or your mobile network. A stamp that didn’t record while the service was down can be added by the business afterwards.
